Terms and Conditions

These Terms and Conditions govern access to and use of this website and of the municipal urban planning viewers published with Visor Urbanismo. By accessing and using these services, the user agrees to comply with these terms.

1. Purpose and scope

These terms govern the use of:

  • visorurbanismo.es, the product website.
  • The municipal viewers published on the subdomains of visorurbanismo.es (for example, benahadux.visorurbanismo.es) or on those of inventariomunicipal.es, from which the urban planning information of each municipality is consulted.

Service owner: Inventarios de Bienes y Derechos, S.L. (Inventario Municipal), Tax ID (CIF) B26849950.

Purpose: to offer a digital tool for consulting municipal urban planning information: land classification and category, planning areas, applicable zoning ordinances, rural land conditions and cadastral data (from the Spanish Cadastre), over different base maps.

2. Access and use

2.1. Access requirements

  • Consulting the municipal viewers is public and free of charge and does not require registration.
  • Administering the viewers (layers, maps and configuration) requires an authorized user account. Whoever has one must keep their credentials confidential and use it only for authorized purposes.

2.2. Appropriate use

The user undertakes to use the services responsibly and in accordance with the law. The following are strictly prohibited:

  • Accessing the administration without authorization or with third-party credentials
  • Downloading the information of the viewers massively or by automated means
  • Using hacking, SQL injection or similar techniques
  • Transmitting malware, viruses or malicious code
  • Carrying out activities that interrupt or degrade the service

3. Informative nature of the urban planning information

The information offered by the viewers and the urban planning reports they generate is for information and outreach purposes only, and is not legally binding, certified or authoritative:

  • It is not a certificate or official zoning certificate.
  • It does not prove any urban planning rights or obligations.
  • It may not be fully up to date.

The urban planning information comes from the current municipal urban plan and the layers provided by each Town Council; the mapping and plot data, from the Directorate General for the Cadastre; and the other layers, from public services of the Junta de Andalucía (Andalusian regional government), the Provincial Council of Almería and the State.

For official information or information with legal or administrative effect, the user must contact the relevant Town Council or the competent authority. All of the above is without prejudice to property rights and to the rights of third parties.

4. Intellectual and industrial property

The Visor Urbanismo software, its design, source code and documentation are the property of Inventarios de Bienes y Derechos, S.L. The urban planning information, the mapping and the municipal coats of arms belong to their respective owners (each Town Council and the public bodies cited as sources), and are protected by Spanish and international intellectual and industrial property law.

Prohibition of reproduction: the reproduction, distribution, modification, transmission, storage or commercial use of the content without prior and express written authorization is not permitted, without prejudice to the licenses under which public bodies publish their own data.

5. Responsibilities

5.1. User responsibility

The user is responsible for:

  • The use they make of the information consulted and the decisions they take based on it
  • Compliance with the laws applicable when using the service
  • Protecting their access credentials, if they have any
  • Immediately reporting any unauthorized access

5.2. Limitation of the owner’s liability

The owner shall not be liable for:

  • Errors, omissions or lack of updating of information coming from the municipal urban plan or from public sources
  • Decisions taken on the basis of the information in the viewers without checking it with the Town Council or the competent authority
  • Temporary interruptions of the service due to maintenance or to the failure of third-party services
  • Damages arising from unauthorized access or misuse of the service

Note: the service is provided “as is”, without any express or implied guarantee of continuous availability.

6. Personal data protection

Personal data is processed in accordance with the regulations in force, in particular Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

Users can exercise their rights of access, rectification, erasure, restriction, portability and objection by contacting the data controller.

7. Changes to the terms

The owner reserves the right to modify these Terms and Conditions at any time. Changes take effect from their publication on this website.

Users are advised to review these terms periodically. Continued use of the services after changes are published constitutes acceptance of the new terms.

8. Duration and suspension of the service

The owner reserves the right to:

  • Suspend or cancel any user’s access in the event of a breach of these terms.
  • Modify, suspend or discontinue a viewer or any feature, with or without prior notice, including the suspension of a municipality’s public viewer.
  • Set usage limits to guarantee the availability of the service.

9. Applicable law and jurisdiction

These Terms and Conditions are governed by the Spanish law in force.

For the resolution of any dispute arising from these terms or from the use of the services, the parties submit to the jurisdiction of the Courts and Tribunals that are competent under the applicable law.
